This privacy policy explains what information is collected and how it is used and protected by TeleClear, LLC., its websites, mobile applications, and other products and services (the “Services”). It also explains the choices you have about the way this information is collected and used.  By registering for or using the Services, you agree to be bound to the terms and conditions of this privacy policy.  In this policy, “TeleClear” refers to TeleClear, LLC. and its subsidiaries and other affiliates.

WHAT INFORMATION WE COLLECT

When you use our Services, we may collect and store information from you directly.

We may collect information from you when you register directly with us to use our mobile applications or any other part of our Services. That information may include, among other things, your full name, email addresses, login information, device identifiers, and other information you provide.

When you use one of our applications, we collect and store certain information that you provide directly. We also collect information about your use of the Services.

COOKIES AND SIMILAR COLLECTION METHODS

We also collect technical information about your usage of the Services, and we use various technologies to collect information about cookies, IP addresses, device type and device identifiers, application state and the date and time of activity with our applications, and other similar information. We may associate this information with your user ID number for our internal use.

HOW WE USE THE INFORMATION WE COLLECT

We use your information primarily as necessary to provide you with the Service, including in one or more of the following ways: to create your accounts and allow use of our applications, to provide technical support and respond to user inquiries, to prevent fraud or potentially illegal activities, and enforce our other agreements with you, to notify users of application updates, and to inform users about new products or promotional offers.

SHARING YOUR INFORMATION

We do not share personal information with third parties for their direct marketing purposes unless you affirmatively agree to such disclosure.

Your information may be disclosed or reported:

(i) if we have a good faith belief that we are required to disclose the information in response to legal process (for example, a court order, search warrant or subpoena); (ii) to satisfy applicable laws, (iii) if we believe that the Services are being used to commit a crime, including, but not limited to, to report such criminal activity or to exchange information with other companies and organizations for the purposes of fraud protection and credit risk reduction, (iv) if we have a good faith belief that there is an emergency that poses a threat to the health or safety of a person or the general public, and (v) in order to protect the rights or property of TeleClear, including to enforce our Terms of Service.  We may also provide your information to third party companies to perform services on our behalf, including payment processing, data analysis, message delivery, hosting services, customer service, and marketing. If we sell all or a portion of our business, we may transfer all of your information, including personal information, to the successor organization.

SECURITY OF YOUR INFORMATION

We implement security measures we believe are reasonable to protect your information. It is important that you protect and maintain the security of your account and you need to immediately notify us of any unauthorized use of your account.

HOW TO ACCESS AND UPDATE YOUR INFORMATION

You can access and edit your information provided to us through individual settings in the Services. If you want to delete your accounts and information on our Services, please contact us directly.

CHANGES TO OUR PRIVACY POLICY

We may update this privacy policy from time to time. If we make material changes to our privacy policy, we will notify you and other users by posting the changes through the Services or by using the contact information you have on file with us and will indicate when such changes will become effective.  By continuing to use our Services you are agreeing to be bound by any changes or revisions made to this privacy policy.

GRAVATAR

TeleClear uses a feature from Gravatar that collects and tracks personal information in order to provide seamless integration for your personalized avatar in our system.

PERSONAL DATA

The processing of personal data in SDK A/S is in accordance with the following principles:
We only process personal data lawfully, fairly and in a transparent manner in relation to the data subject, such as name, email, address, phone number. We only collect personal data for specified, explicit and legitimate purposes

INDIRECT END USER PHONE CONTACT INFORMATION (Personal Identifiable Information)

TeleClear acts as a data processor with regard to indirect end user personal identifiable information and our Clients act as the data controller of such data. In the course of TeleClear’s processing and protection of such data, all use will be in conformity with the data controller’s instructions.

Specifically, only when enabled via system permission on TeleClear Android and TeleClear iOS, TeleClear shows personal contacts within the respective application. When the user sends an SMS message to one of his/her phone contacts, or when the user initiates a call to one of his/her phone contacts, the phone number is sent securely through TeleClear’s API. TeleClear does not store this number with any other PII, and it cannot be directly or indirectly attributed to any person or persons; TeleClear stores only the phone number and pertinent metadata so as to be compliant with all applicable state and federal laws, and TeleClear does not share this data with any advertisers or third parties under any circumstances. A user can revoke phone contact access on his/her mobile device at any time, and his/her app experience is not hindered or interrupted.

TeleClear Android and iOS also uses Gravatar, only when enabled via Settings and UIConfigs, which is a service that provides avatar images linked to the MD5 hash of the user’s email address. This means that, only when Gravatar use is enabled, we hash each contact’s email address and send it to Gravatar to try and retrieve an avatar image. MD5 hashes cannot be directly or indirectly attributed to any person or persons, and we only send the MD5 hash to Gravatar, never the email address in plain text. As with phone contacts, a user can revoke Gravatar access at any time in Settings or via UIConfig, and his/her app experience is not hindered or interrupted.

CONTACTS USAGE

This part of the privacy statement describes how the TeleClear collects and uses the contact information you provide by granting the contacts access permission

in the TeleClear Android and iOS application. It also describes the choices available to you regarding our use of your information and how you can access and update this information.

We access the following personal information from your address book:

• Contacts' names
• Contacts' email
• Contacts' telephones
• Contacts' organization
• Contacts' postal address
• Contacts' birthday
• Contacts' gender

We use this information to:

• Populate your Contacts data in the app.
• Import your favorite contacts into the QuickDial list, if you also enable the "Busy Lamp Field" feature on a contact, the favorite contact's number (URI) will be included in your SIP traffic but will not be stored anywhere.

We will only use your Contacts information for the specific reason for which it was provided to us.

You can execute your right to erase the collected contact data by uninstalling the MobileConnect or SNAP Mobile application at any time.
